I, the “Buyer/Customer”, understand and am in agreement with Gorilla Bats that all pre-rolled and shaved bats sold, as well as any and all bats sent in for the purpose of shaving and rolling, are no longer legal to use in sanctioned leagues, tournaments, or any other associations where such modifications are deemed illegal. These modified bats are used for the purpose of homerun derbies, exhibitions, or leagues where it is permitted by law and there are no bat restrictions. If you use such bats in leagues or tournaments where they are not permitted, you the buyer/customer, will be fully responsible for any penalty or prosecution set forth by any person(s) or association(s). 

Buyer/Customer has read and understands ALL of the following:

After altering a bat(s) they are no longer deemed approved by ASA, USSSA, NSA or any other softball association and would not be legal for use in sanctioned play or tournaments where bats are certified to stay under a certain performance level or anywhere it is deemed illegal.

All bats that are altered in any way do not have a warranty (ie: shaved, rolled)

It is your (the buyer/customer’s) responsibility to verify where it would be legal or not legal to use the bat(s).  

Shaving and/or rolling the bat(s) will reduce its life span and durability as well as exceed the manufactured performance standards.

These bat(s) are not to be used in under 65-degree weather as it is more susceptible to breaking or cracking

It is suggested that protective gear must be worn while using these bat(s) to further ensure the safety of yourself and/or others.

Shaved and/or rolled bats are not eligible for exchanges or refunds.

All bats from Gorilla Bats will be indicated that they have been modified with a label. It is then the buyer/customer’s responsibility to remove the label if they choose to do so.

Risks of Alterations - Due to the altering and customizing of these bats, there are times when there may be occasional flaws on the bat(s). Gorilla Bats does not guarantee that shaved bats will be modified/altered without some cosmetic flaws. Gorilla Bats does our absolute BEST in order to alter your bat to the specifications required WITHOUT any cosmetic flaws, however, some bat(s) may have flaws from factory and/or there may be some blemishes due to the nature of our work. You, the buyer/customer, acknowledge that this can and may happen as well as acknowledge that Gorilla Bats is NOT liable or responsible for the following cases involving the process of altering the buyer/customers bat(s) as requested: end cap creases and end cap replacement (if necessary), paint cracks, decal creases, minor scratches and/or blemishes. Once again, these CAN happen, however, Gorilla Bats will do everything possible to provide you with the best work that is free of any of the above.

Sticker Weight – Depending on your order, some bat(s) may require a weight after being shaved to be the same weight as before it was shaved. Gorilla Bats will do their best to provide you with the appropriate weight to match accordingly to your specified order. The adjusted weight may or may not match the finished weight requested, however, we will make our best efforts to supply the bat(s) ordered with a sticker weight that is the same weight as requested or as close as possible to the finished weight. Note: You the buyer/customer are to provide Gorilla Bats with a specific sticker weight request if deemed necessary. Without the buyer/customer’s consent to provide a specific sticker weight, Gorilla Bats will use their own judgement in providing a bat(s) with appropriate sticker weight relative to the finished weight on the order requested.

We, Gorilla Bats, ARE NOT third-party resellers and are NOT an authorized dealer. 

If any legal action or other proceeding is brought for the interpretation or enforcement of this disclaimer, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this disclaimer, then the successful or prevailing party or parties will be entitled to recover their reasonable attorney fees and other litigation costs (including the cost of experts) incurred in that action or proceeding, in addition to any other relief to which they may be entitled. This disclaimer will be enforced and interpreted according to the laws of the State of Florida.
